If someone reports you to the ministry
Tips on what to do before you go to the first appearance
- If you disagree with the ministry's decision to remove your child, get a lawyer to help you explain your arguments to the judge.
- If you have not had a chance to speak with a lawyer, you can ask the court to postpone ("adjourn") the presentation hearing until you do get legal help.
- Get help from a child protection advocate.
- Develop a good working relationship with the social worker handling your file. Try to negotiate a plan that allows you to continue caring for your child (perhaps with supervision) or to have a relative care for your child.
- If the judge says your child will be in care, ask if you can visit your child. This is called "access." You can ask to see your child at a time and place that is convenient for you. If you do not ask for access at the presentation hearing, you may have to wait weeks before you have another opportunity.
